If this dog is not yet spayed/neutered, buyer agrees he/she will have dog spayed/neutered by seven months of age. A copy of the receipt from the performing vet must be sent to breeder. Registration papers are withheld until proof of spay/neuter is sent to seller. If spay/neuter receipt is not sent to seller by 8 months of age buyer forfeits all registration papers and health guarantee’s & support.

Any/All breeding is prohibited. Breeding or allowing said dog to be bred whether on purpose or by gross negligence obligates the purchaser to return seller, by cashier’s check amount of the purchase price within thirty (30) days.

Buyer Agrees

Co-Ownership of this dog with anyone other then buyers/seller listed in this contract is prohibited.

Said Puppy’s registered name shall begin with DoxPaw’s.

To inform seller of any titles or awards won  by said dog for our breeding records, and buyer will inform seller of any change of name, address, or phone so that seller may keep track of all puppy’s bred by this kennel.

To keep said dog on recommended schedule of vaccinations and de-wormings as determined by seller (based on the recommendations of the AVMA) *NO LEPTO!!

Right of First Refusal

That ownership and/or possession of this dog will not be transferred without written consent from seller.
Under no circumstance shall said dog be transferred or released to an animal shelter, humane society, or rescue group. Failure to contact seller for Right of First Refusal obligates the purchaser to return seller, amount of the purchase price within thirty (30) days. 

In the event that the buyer desires to sell, transfer, give away or otherwise dispose of said dog, the buyer grants unto the breeder the Right of First Refusal, to take possession of said dog. Any transfer back to the breeder shall be accompanied with the appropriate registration papers properly endorsed by the owner. 

 It is understood that if the dog is returned for any reason, seller is not obligated to refund any of the purchase price and if so elected by seller to give a refund any refunds given will not exceed half the purchase price.

Guarantees: 

7 Day Health Guarantee: Your puppy is guaranteed to be healthy and free of diseases to the best of our knowledge for a period of seven days from date of purchase. Buyer is encouraged to schedule a vet visit within the first seven days from date of purchase to establish that the pup is in good overall health. If within this seven days puppy is found to be unhealthy by a licensed veterinarian you have three options.

1. Seller will provide recommended treatment: Seller will not cover any treatments of an ill puppy unless we have concurred with vet's treatment and then we will send the medical treatment to buyer via priority mail, some vets overcharge or mistreat. We can get any treatments for a fraction of the cost that most vets offer them for. If you decide to treat with your vet then it is your financial responsibility.

2. Return puppy and all paperwork to the seller for a replacement puppy. 

3. Return puppy and all paperwork to the seller for refund of the purchase price minus the $200 deposit 
    and any spay/neuter fee’s.

After this period no cash refunds will be given.

This puppy is guaranteed against fatal/disabling hereditary defects for 5 years provided that it is maintained on a premium diet as well as supplemented with NuVet Vitamins on a daily basis. NuVet Vitamins shall be ordered under breeder’s code # 80134, Nuvet and seller keep these order records. At any time should said dog be removed from it’s daily NuVet supplement, All guarantee's are void. 5 year Health Guarantee: Said dog is guaranteed against fatal or disabling hereditary defects, such as but not limited to Heart, Spine and Bone defects, until the age of 5 years. This is a complete head to tail guarantee.

NOTE: Dogs that are injured in the hip or eye area prior to receiving their OFA / C.E.R.F. registration certificate are not eligible for the hip or eye guarantee. 

It is your responsibility to have your dogs heart, hips and eyes checked and certified by such registries. Copies of results, must be sent to seller for continuing records on this dog and to help us evaluate our breeding program

Although there is no guarantee that a puppy won’t get one of these diseases, we are making every effort to avoid such an occurrence. In the event your puppy is diagnosed with a fatal or disabling disease all OFA, and/or CERF. reports and the veterinary report must be sent to seller. Provided the contract terms have been met, we will replace the puppy with another puppy of equal quality as soon as one becomes available.

At our option we may require the owner to return original dog, before providing a replacement.

If we allow and buyer chooses to keep said dog and it is not already spayed/neutered a certificate of sterilization (including microchip #) and all registration papers will be required before any replacement 
is given. No Cash Refunds!

2 year Temperament Guarantee: Seller strongly recommends that buyer attends a minimum of two completed obedience courses with puppy and provide proper socialization opportunities.

Should said dog exhibit aggressive behavior or behavior that buyer deems intolerable and irreversible, buyer will provide seller with proof that puppy has been sufficiently socialized and that obedience classes have been attempted with no significant results. Upon receipts of proof seller will take the animal back for re-training, or euthanasia at sellers option. Seller has the right to request the dog be seen by a trainer for evaluation. If such evaluation reveals said dog has not received adequate and proper socialization, Seller will accept puppy back but no replacement will be given.

Medical Treatments/Expenses:
Under NO CONDITION will we refund, replace, or treat a puppy, where we are not notified of its being ill within 48 hrs. We may require documentation from your vet as well as to speak to them so please have this information available.

We reserve the right to have a 2nd opinion at a vet of our choosing, to have the hip x-rays sent to us, and/or to discuss this matter and the animal’s past medical history with your veterinarians. Seller claims no financial responsibility for any surgery or procedures of any type.

Replacements
1. Buyer is responsible for all shipping/transportation costs to/from seller for original dog and replacement.
2. A replacement pup of equal quality and value will be given when one is available.
3. Replacements may take up to one (1) year. 
4. Replacement dog will be mutually agreed upon by both parties and will be of comparable quality/value. 
5. It is understood that the replacement dog may not be from the same parents of original dog. 
6. Returned dogs must be shipped prepaid. Otherwise we will not ship replacement until reimbursed.
7. If buyer does not want a replacement that is their option but no cash refunds will be given!
8. We reserve the right to give a refund rather than replacement if we feel it is in the dogs best interest.

Refunds (At our discretion, should we decide to give a refund rather then replacement)
1. Refunds will be given within 90 days.
2. Deposits ($200) and shipping fees are nonrefundable and will be subtracted from refunds.
3. Spay/Neuter and Micro-chipping Fee’s ($200) are nonrefundable and will be subtracted from refunds.
4. Buyer is responsible for all shipping/transportation costs to/from seller.
5. The extent of our liability in this matter can never exceed the purchase price of the animal. 

MISC.
1. Applicable guarantees will be null and void if the dog has suffered injury, neglect or mistreatment.
2. No replacements will be given if the dog has been euthanized or treated without breeder’s consent. 
3. Disabling means that the disease affects the dogs quality of life or ability to live a normal life.
4. If not kept on NuVet Vitamins all health guarantees are null/void.

We make every effort to see that all of the puppies are sound physically and mentally. However, as with all living creatures there are occasionally defects, or health problems. We will guarantee our puppies to be healthy, socialized and well bred and that should a health issue arise we will stand behind them, provided contract terms are met.

Any check, money order etc. returned for any reason (NSF-Closed account etc.) will be considered theft by fraud and will be prosecuted within the fullest extent of the law. The dog will be re-claimed and buyer sued for any and all costs to do so, under no circumstances will buyer be allowed to keep or repurchase dog.
Should court action be necessary to enforce/interpret this contract it shall be done in the state of Minnesota, County of Hubbard under Minnesota Law. 
By signing this contract, I acknowledge that I have read all of the terms and conditions as stated above and agree to abide by this written agreement.
